Welcome to Sunshine Coffee Company, LLC, doing business as Pacific Sunshine Coffee Company (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website www.pacsuncoffeeco.com, our products, and services (collectively, the “Services”).

We strive to ensure accurate product descriptions, pricing, and availability. However:

  • We may limit quantities purchased
  • Product packaging may vary from images shown

4. Orders and Payment

All orders are subject to acceptance and availability.

We reserve the right to:

  • Refuse or cancel any order
  • Limit quantities per customer
  • Cancel orders suspected of fraud or unauthorized activity

Payment must be made at checkout using approved payment methods. By submitting payment information, you represent that you are authorized to use the payment method.

If an order is canceled after payment, a refund will be issued to the original payment method.

5. Shipping and Delivery

We utilize third-party fulfillment and drop-shipping providers.

  • Shipping times are estimates only and not guaranteed
  • Delivery delays may occur due to carriers or suppliers
  • Title and risk of loss transfer to you upon delivery to the carrier
  • We are not responsible for shipping delays outside our control

Customers are responsible for providing accurate shipping information.

6. Returns, Refunds, and Damaged Products

Due to the perishable nature of coffee products, all sales are final.

Exceptions may be made for:

  • Damaged products
  • Defective products
  • Incorrect items shipped

To request resolution, you must contact us within 5 days of delivery with:

  • Order number
  • Description of the issue
  • Photographic evidence (if applicable)

At our discretion, we may provide:

  • Replacement product
  • Refund
  • Store credit

We reserve the right to deny requests that do not meet these requirements.

7. Subscriptions (If Applicable)

  • Subscriptions automatically renew until canceled
  • You may cancel before the next billing cycle
  • Pricing and delivery frequency will be disclosed at enrollment
  • We reserve the right to modify or discontinue subscription services

8. Intellectual Property

All content on the Site, including logos, designs, text, graphics, images, and software, is owned by or licensed to Sunshine Coffee Company, LLC dba Pacific Sunshine Coffee Company and protected by intellectual property laws.

You may not:

Our total liability shall not exceed the amount paid for the specific product giving rise to the claim.

You agree to indemnify and hold harmless the Company and its affiliates from any claims, damages, losses, or expenses arising from:

  • Your violation of any law or third-party rights

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

You agree to exclusive jurisdiction in the state or federal courts located in Orange County, California.

15. Dispute Resolution and Arbitration

Before filing a claim, you agree to attempt informal resolution by contacting us.

If unresolved, disputes shall be resolved through binding arbitration administered by the American Arbitration Association in Orange County, California.

Any claim must be filed within one (1) year of arising.

16. Force Majeure

We are not liable for delays or failure to perform due to events beyond our reasonable control, including:

  • Natural disasters
  • War or terrorism
  • Labor disputes
  • Supply chain disruptions
  • Government actions
  • Internet or telecommunications failures

17. Severability

If any provision is found invalid or unenforceable, the remaining provisions shall remain in full force.

18. Entire Agreement

These Terms, together with our Privacy Policy and other posted policies, constitute the entire agreement between you and the Company regarding the Services.
